Fresh Court Documents Reveal Why INEC Omitted Kano NDC Candidate’s Name

The Independent National Electoral Commission (INEC) withheld the name of the Nigeria Democratic Congress (NDC) governorship candidate for the 2027 Kano State election because of an interim order issued by the Federal High Court in Kano.

Fresh court documents obtained from the court have revealed that the electoral commission was directed not to publish the name of any candidate submitted by the NDC for the governorship election until the court considers a pending application in a dispute involving members of the party.

The documents relate to Suit No. FHC/KN/CS/440/2026, which was instituted against INEC and the NDC by three party members identified as Garba Umar Isa, Yau Nasiru and Atiku Jamilu Abubakar.

The plaintiffs approached the Federal High Court to challenge the process that produced Comrade Aminu Abdussalam Gwarzo as the party’s governorship candidate and Mustapha Rabiu Musa Kwankwaso as his running mate.

They reportedly questioned the manner in which the two candidates emerged, alleging that Senator Rabiu Musa Kwankwaso, leader of the Kwankwasiyya Movement, had taken a unilateral decision in determining the party’s governorship ticket.

According to the court documents, the applicants specifically challenged the alleged nomination of Gwarzo and Mustapha, who is Kwankwaso’s son, for the governorship and deputy governorship positions.

They subsequently filed an ex parte application on October 17, 2026, asking the court to intervene in the matter and prevent INEC from proceeding with the publication of the disputed candidates’ names.

Justice Amobeda, who presided over the case, granted an interim order on October 27, 2026, directing the electoral commission to suspend the publication of the NDC’s governorship candidates’ names for the 2027 Kano election pending the hearing of the substantive application.

The order specifically restrained INEC, its officers, agents and representatives from publishing the name of any candidate on the party’s governorship list until the court determines the motion on notice.

The judge also directed the commission not to make any changes to its final governorship candidates’ list, which was published around October 10, 2026.

Under the order, INEC was restrained from tampering with, altering, adding to or removing any name from the published list while the legal dispute remained before the court.

The court further directed that the order and other relevant documents be served on the defendants to ensure that all parties were formally notified of the proceedings.

Justice Amobeda also ordered an accelerated hearing of the case, indicating the need for the dispute to receive prompt judicial attention.

The development has provided a legal explanation for INEC’s decision not to publish the NDC governorship candidate’s name, following questions over the omission from the commission’s list ahead of the 2027 general elections.

Although the party had presented Gwarzo as its governorship candidate, the pending court dispute has placed the publication of his name under judicial consideration.

The situation also affects the status of his running mate, Mustapha Rabiu Musa Kwankwaso, whose emergence was equally challenged by the applicants.

The case was initially scheduled for November 2, 2026, when the court was expected to hear the matter.

However, proceedings could not continue as planned after counsel representing Gwarzo approached the court with an application seeking to join him as a party to the suit.

The application was aimed at securing his participation in the legal proceedings, given that the outcome of the case could directly affect his position as the NDC’s governorship candidate.

Following the development, the court adjourned the matter until November 16, 2026.

The adjournment means that the dispute over the party’s governorship nomination will remain unresolved until the court resumes hearing the case.
